    Is it Constitutional for States to Regulate Pharmaceutical Gifts and Meals to Doctors?

    A U.S. Supreme Court ruled that a Vermont law, which prohibited data mining by pharmaceutical companies, but allowed researchers, journalists, and insurance companies to purchase prescriber-identified prescription data was "inherently suspect." The Court also determined that the law violated First Amendment protections by restricting commercial speech. This ruling may challenge the current pharmaceutical gift laws enacted in about 25 states.
